Woman Pleads To Selling Deadly Drug

HARRISONBURG — A Harrisonburg woman accused of selling drugs to a Timberville man who overdosed and died in November 2011 pleaded guilty Thursday in U.S. District Court in Harrisonburg.
 
Jacie Elizabeth Kyger, 28, waived her right to be indicted and pleaded guilty to one count of felony distributing fentanyl. Fentanyl is a powerful synthetic narcotic that is manufactured under various brand names and is often used as a pain reliever during cancer treatments.
 
As part of a plea deal, Kyger agreed to a 15-year sentence recommendation. She was sentenced on Thursday.
 
“This case shows how dangerous and highly addictive drugs like fentanyl can be,” U.S. Attorney Timothy J. Heaphy said in a statement Friday. “Ms. Kyger exploited the weakness of others when she sold fentanyl, and her acts ultimately led to an untimely death.”
 
Prosecutors say Kyger had an ongoing narcotics relationship with Kevin Michael Moyer, who was found dead at his parents’ home on Nov. 5, 2011.
 
A police investigation showed that a large number of text messages were sent between the pair discussing Moyer purchasing fentanyl from Kyger. In early November 2011, prosecutors said, the two sent texts to each other about Kyger selling Moyer a fentanyl patch and two Percocet pills. Percocet is a pain reliever that combines acetaminophen and oxycodone, a synthetic narcotic.
 
According to prosecutors, Kyger sold Moyer the drugs for $60 on Nov. 4, 2011, the day before he died.
 
Prosecutors say a syringe containing fentanyl and a portion of a fentanyl patch were found next to his body. A medical examiner ruled he died of “acute fentanyl toxicity.”
